1. Identification

These Terms and Conditions regulate the contracting of services offered by Balea Charters (owned by Matthias Peeters, Tax ID: Z0776008Q, Address: Laaglandweg 66, 2610, Wilrijk, Antwerp, Belgium, Email: info@baleacharters.com) through the website www.baleacharters.com.

2. Purpose

These Terms and Conditions regulate the reservation and rental of boats and nautical services offered by Balea Charters to its customers.

3. Booking and Payment

Reservations can be made through the website, by phone, by email, or via WhatsApp.
To confirm a booking, the customer must provide their full name, email address, and phone number, and pay a deposit or the full amount, as specified at the time of booking.
The remaining balance (if applicable) must be paid before the start of the service, according to the instructions provided by Balea Charters.
Payment methods accepted: credit/debit card, bank transfer, or other methods indicated on the website.

4. Prices

All prices are indicated in euros (€) and include VAT and other applicable taxes unless otherwise stated.
The price includes the services detailed in the description of each rental (e.g., boat, fuel, captain, drinks, snacks, paddle boards, water toys, etc.).
Any additional services or extras not included in the initial booking must be requested and paid for separately.

5. Cancellations and Refunds

The customer may cancel the booking up to 7 days before the scheduled departure to receive a full refund of the deposit.
If the cancellation is made less than 7 days before the scheduled departure, the deposit will not be refunded.
In case of adverse weather conditions that prevent navigation, Balea Charters will offer to reschedule the booking or, if not possible, will refund the full amount paid.

6. Customer Obligations

The customer must provide accurate and complete information when making the reservation.
The customer and their guests must comply with the captain’s instructions and the safety regulations on board at all times.
It is forbidden to bring illegal substances or dangerous items on board.
The customer is responsible for any damage caused to the boat or its equipment due to improper use or
negligence.

7. Liability

Balea Charters is not responsible for the loss or theft of personal belongings during the service.
Balea Charters will not be liable for delays or cancellations due to force majeure or circumstances beyond its control (e.g., weather, technical problems, etc.).

8. Data Protection

Personal data provided by the customer will be processed in accordance with our Privacy Policy.

9. Modifications

Balea Charters reserves the right to modify these Terms and Conditions at any time. The applicable conditions will be those in force at the time of booking.

10. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. Any dispute will be submitted to the courts of Palma de Mallorca, unless otherwise provided by law.
